Cops receive summons all the time to appear in traffic court. They are required to attend – it’s NOT optional, but they sometimes miss court. Some of the reasons they might miss a court date include: They are out sick, They forget, they are on vacation, they are in another court on a more pressing case, They are out on leave.
“Officer Roulette” is the practice of fighting a traffic ticket with the hopes that the officer won’t show up in court. You are taking a chance though, which is why it’s called “roulette.” There are circumstances wherein you can orchestrate things to make sure the officer misses your court date. If the officer lists his or her vacation dates on the citation, you may be able to employ your constitutional right to a fair and speedy trial. Here’s what I mean:
If you can get your court date scheduled during the officer’s vacation, you will beat your ticket. You can contact the courthouse and request a trial during a specific time frame. You have the right to request a “fair and speedy trial” so if the officer is going to be on vacation soon, you should tell the court clerk that you wish to have your trial as soon as possible. If the officer’s vacation is a month or so away, you can request continuances to push the trial date back. You can cite child care or employment issues as an excuse for needing to push the trial back.
If you can get your trial scheduled during the officer’s vacation leave, your ticket must be dismissed because the officer won’t be there to testify against you. You win!
